HOW TO ENTER
The Sweepstakes must be entered by submitting an entry using the online form provided at www.at3tactical.com/pages/giveaways and pass any verification requirements (email or fraud score) set by the Sponsor. The entry must fulfill all requirements of the Sweepstakes, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications of the Sweepstakes may be disqualified at the sole discretion of the Sponsor. You must provide the information requested. You may not enter more than one (1) time by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules of the Sweepstakes, your submission may be disqualified at the sole discretion of the Sponsor.
ELIGIBILITY AND LIMITATIONS
Sweepstakes is open to legal residents of the 50 United States and the District of Columbia who are age [21] or older, except for residents of Rhode Island, New York, and Florida, who are not eligible to win. Employees, officers and directors of Sponsor, its parent, subsidiary and affiliated companies, their advertising agencies, and any other entities involved in the Sweepstakes are not eligible to win. Immediate family members of such persons, including spouses, siblings, parents, and children, and any other persons residing at the same household whether or not related are also excluded from eligibility. If you have won a prize in any sweepstakes sponsored by AT3 Tactical in the twelve months prior to the starting date of this Sweepstakes, you are not eligible to win a prize in this Sweepstakes. Void in Rhode Island, New York, Florida, and where prohibited by law.
PRIZE(S)
Sponsor will select one (1) winner in a random drawing from among all eligible entries received during the Sweepstakes Period. Winner is solely responsible for any and all costs associated with maintenance and use of the prize, including but not limited to additional magazines and ammunition, FFL transfer fee, background check, and taxes, if applicable to Sweepstakes Prize(s). Odds of winning are equal to everyone who signed up and only one entry per customer is eligible during the Sweepstakes Period.
No prize transfer is permitted prior to award. If a potential prize winner is unable to accept or receive shipment of a prize due to applicable gun laws in his or her state of residence, Sponsor will work with potential winner to find a prize of equal or lesser value that is legal for the potential winner in that state, with the final prize determined in the sole discretion of Sponsor. Otherwise, there is no cash in lieu of prize or substitution of prize, except that Sponsor reserves the right to substitute a prize of equal or lesser value in the event the stated prize becomes unavailable for any reason. All taxes, fees, licenses or other charges on prize are the sole responsibility of the winner. Federal, state and local taxes on the prize are the sole responsibility of the winner. As required by law, Sponsor will issue a 1099 Tax Form if the amount of the Prize(s) exceeds $599.99 or as applicable by law. Sponsor will not ship any prizes to an address outside of the United States.
WINNER SELECTION AND NOTIFICATION
Potential winner will be notified via email at the e-mail address provided in the entry within three business days of the drawing. Potential winner must sign and return a declaration of eligibility and a liability/publicity release and an IRS Form W-9 (if applicable) within seven (7) days of receipt in order to formally claim the prize. Potential winner must also meet all legal requirements for receipt and ownership of the prize.
If any prize notification is returned as undeliverable, or if a potential winner fails to return the signed documentation within the time allowed, or if a potential winner is determined to be ineligible or to have violated these Official Rules in any way, as determined in the sole discretion of Sponsor, that potential winner will be disqualified, the prize will be forfeited, and an alternate winner will be selected from among remaining eligible entries, as applicable. However, if Sponsor is unable to award the prize after attempts to reach three potential winners, the prize will remain un-awarded. Returned and unclaimed prizes will not be awarded. If forfeiture of a prize occurs after a winner has been confirmed and the prize awarded, no alternate winner will be selected.
RELEASE AND CONSENT
By entering this content (e.g., photo, video, text, etc.), You understand and agree that the Sponsor and anyone acting on behalf of the Sponsor or its respective licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. By entering this content, you represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, you will be disqualified at the sole discretion of the Sponsor. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless AT3 Tactical Giveaways from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which AT3 Tactical Giveaways may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.
TERMS AND CONDITIONS
The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes should virus, bug, non-authorized human intervention, fraud, or other cause beyond the Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such cases, the Sponsor may select a winner(s) from eligible entries received before and/or after the action taken by the Sponsor if appropriate. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Terms & Conditions. The Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Sweepstakes rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.
PRIVACY
By entering into the Sweepstakes, you agree that Sponsor may use your personal information for both online and offline direct marketing purposes in accordance with its privacy policy located at https://www.at3tactical.com/pages/privacy-policy. You may subsequently opt out of receipt of those communications at any time by following the directions in the e-mail or in the privacy policy. Your opt-out status will not affect your participation or chances of winning in this Sweepstakes.
By participating in the Promotion, each entrant agrees to indemnify and hold harmless Sponsor and all Released Parties from and against any and all injuries, losses, damages, claims and actions of any kind arising from or relating to participation in the Promotion, or acceptance, possession, use, misuse or non-use of any Prize that may be awarded, including, without limitation, actual, direct, indirect, consequential, punitive, special, or other damages. By accepting a Prize, each winner further releases the Sponsor and all Released Parties from any and all claims, liability, loss or damage arising out of or in connection with the awarding, receipt, possession and/or use or misuse of any Prize or participation in any Prize-related activity.
The protections and benefits of this Section 6 shall be construed as also applying for the protection and benefit not only of Sponsor but of all Released Parties as well.
LIMITATION OF LIABILITY
By entering, all entrants release Sponsor and its affiliates, subsidiaries, parent companies, and all of their respective officers, directors, agents, promotional partners and employees (“Released Parties”) from any and all liability with respect to or in any way arising from this Sweepstakes and/or acceptance or use of the prize, including liability for personal injury, death, damages, or loss. By entering, all entrants release Facebook, Twitter, Instagram, YouTube and Twitch.tv from any and all liability with respect to or in any way arising from this Sweepstakes. Sponsor is not responsible for prize quality or utility and disclaims all warranties associated with the prize. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by Website Contest Page users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of submissions and entries in the Sweepstakes. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, social media platforms, computer equipment, software, applications, failure of email, technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any person’s computer, mobile device, or data related to or resulting from participating or downloading materials in this Website Contest Page or Sweepstakes. Sponsor is not responsible for cheating or fraud by any entrants. Any activities intended to disrupt or interfere with the proper play of the Sweepstakes, or to defraud the Sponsor in any way, may be prosecuted to the fullest extent of the law. Participants engaging in any of the foregoing activities will be disqualified and will forfeit any prizes won in the sole discretion of Sponsor. If, for any reason, the Sweepstakes is not capable of operating as planned, including, without limitation, as a result of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and award prizes among eligible entries received. In case of dispute, entries will be declared made by the authorized account holder of the email address provided in the entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet Access Provider, Online Service Provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
DISPUTES
As a condition of participating in this Sweepstakes, participant agrees to be bound by these Official Rules and agrees that any and all disputes which cannot be resolved between the parties, and any causes of action arising out of or connected with the Sweepstakes, shall be resolved individually, without resort to any form of class action. Participants consent to the exclusive jurisdiction of the courts located in the United States and agree that all matters pertaining to these Official Rules and disputes arising hereunder shall be governed by and interpreted in accordance with the laws of the State of Minnesota without regard to any conflicts or choice of law rules or provisions (whether of Minnesota or any other jurisdiction). In any such dispute, under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., his or her costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision of these Official Rules is found to be invalid or unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
GENERAL
The Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social networks that are used to share the Sweepstakes. You understand that you are providing your information to the owner of the Sweepstakes and not to Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social networks.
